New Immigration Changes

The Government is Announcing New Expanded Pathways towards Permanent Residence

Great news! The Australian Government has announced that it will expand pathways to permanent residence for all subclass 482 visa holders. Whilst we have not received all the details yet, what we do know is that this is great news for employers and visa applicants that want to work and remain in Australia.

Here on the Gold Coast at Avis & Funk Law, we understand that migration law is a moving beast and the goal posts are constantly changing, which is why we are here to help our clients get the most up-to-date migration information; let us do the hard work for you.

How the Changes Could Affect YOU!

So, what are the changes? The Australian Government have announced that they will be expanding the pathways to permanent residency before the end of 2023.

Here is what we know….

The Department of Home Affairs has said that, to comply with their commitment to assist with the skills shortage in Australia, the ‘Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (subclass 186) visa will be available for all subclass 482 Temporary Skill Shortage (TSS) visa holders whose employers wish to sponsor them.’

The requirement is that the employee continues to work in the same capacity and role that they undertook when nominated for their TSS visa. The changes will also include occupations not being limited to the medium to long-term skills list, and the eligibility for the TRT stream is reduced from a three year wait, to only a two year wait.

In the meantime, the Government is also helping to promote skilled migration by removing the limits on the number of short-term stream visa applications that visa holders can make in Australia, therefore applicants no longer need to be off-shore to make any further TSS visa applications in the short term stream, helping to simplify the process.

What is Important for You to Know?

The aim of the new pathways to permanent residence is to entice more skilled migration to Australia for a wide range of occupations and make the process quicker, easier, and more streamlined.

Whilst the industry is not aware of the specifics, the team at Avis & Funk Law are keeping a close eye on the details as they are released; we believe it is a great step forward in the migration process and is making permanent residency more obtainable and accessible to skilled migrants.
